BookMyCelebrity Services

BookMyCelebrity is an online platform that enables users to discover, explore, enquire about, and potentially book celebrities, artists, singers, DJs, bands, comedians, anchors, dancers, influencers, performers, and other entertainment professionals through the content, profiles, tools, and interactive functionality made available through the Internet (the “BookMyCelebrity Services”).

These Terms of Use establish the acceptable use requirements for the BookMyCelebrity Services and related content, as well as the rights, responsibilities, obligations, and restrictions applicable to users.

Subject to these Terms of Use, BookMyCelebrity grants you a limited, revocable, non-exclusive, non-transferable right to access and use the BookMyCelebrity Services for their intended purposes. Any use outside the scope of the access permitted under these Terms may result in termination or withdrawal of such permission.

These Terms of Use constitute a binding agreement between you and BookMyCelebrity. By accessing or using the BookMyCelebrity Services, you accept these Terms of Use without limitation or qualification.

BookMyCelebrity does not necessarily control all Content submitted through the Services and therefore does not guarantee the accuracy, completeness, integrity, reliability, or quality of such Content.

To the maximum extent permitted by applicable law, BookMyCelebrity disclaims responsibility for Content submitted or published by third parties.

Opinions, recommendations, statements, or views expressed in Content made available through the BookMyCelebrity Services do not necessarily represent the views of BookMyCelebrity, its owners, employees, affiliates, content providers, advertisers, sponsors, or related entities.

By using the BookMyCelebrity Services, you acknowledge that you may encounter Content that you consider inaccurate, offensive, inappropriate, objectionable, or unsuitable.

BookMyCelebrity is not obligated to pre-screen, continuously monitor, regularly review, edit, or remove all Content associated with the Services. However, we reserve the right to review, moderate, restrict, remove, or modify Content at our discretion where we consider it necessary or appropriate.

Under no circumstances shall BookMyCelebrity be liable, to the maximum extent permitted by law, for errors or omissions in third-party Content or for losses or damages arising from reliance upon or use of such Content.

Responsibility for Your Content (Artist Content)

You are solely responsible for any Content you submit, upload, publish, or make available through the BookMyCelebrity Services (“Artist Content”) and for the consequences of publishing or otherwise making such Content available.

In relation to Artist Content, you represent and warrant that you own or possess all necessary licenses, rights, consents, permissions, and authorizations required to use and submit such Content and to authorize BookMyCelebrity to use it in accordance with the Services and these Terms of Use.

This includes all applicable trademark, copyright, publicity, privacy, image, performance, and other proprietary rights relating to the Artist Content.

You agree not to submit Artist Content that violates these Terms of Use, applicable law, or the rights of any third party.

Because BookMyCelebrity does not permit unauthorized infringement of intellectual property rights through its Services, we may remove or restrict Artist Content when we receive a valid intellectual property infringement complaint or otherwise become aware of a potential infringement.

BookMyCelebrity does not endorse Artist Content or any opinion, recommendation, representation, or advice expressed in such Content and, to the maximum extent permitted by applicable law, disclaims liability arising from such Content.

You agree not to submit Artist Content that violates any applicable local, state, national, or international law or regulation.

Artist Content: Ownership & Licenses

BookMyCelebrity does not claim ownership of intellectual property rights that you lawfully own in your Artist Content.

However, by submitting Artist Content through the BookMyCelebrity Services, you grant BookMyCelebrity a worldwide, royalty-free, non-exclusive license to host, store, use, reproduce, distribute, modify, adapt, publicly perform, publicly display, format, and otherwise make the Artist Content available through the BookMyCelebrity Services for the purposes for which such Content was submitted or made available.

This license allows BookMyCelebrity to display and promote artist profiles, portfolios, photographs, biographies, performance information, videos, and related materials through the Website and other authorized channels used to operate or promote the Services.

The license will generally continue for as long as the relevant Artist Content remains available through the BookMyCelebrity Services, subject to applicable law and any separate written agreement between you and BookMyCelebrity.

You also understand that Content may have been viewed, shared, referenced, or incorporated into other portions of the Services by users or third parties while it was available on the platform.

Accordingly, removal of Artist Content may not necessarily result in immediate removal of every copy, reference, cache, archive, or user-generated use of that Content that was created before its removal.

BookMyCelebrity may retain limited server or backup copies of removed Content where reasonably necessary for security, legal compliance, dispute resolution, fraud prevention, record keeping, or technical purposes.

Permitted Use of Content

The Content associated with the BookMyCelebrity Services, including without limitation text, software, scripts, graphics, photographs, sounds, music, videos, visual interfaces, designs, computer code, interactive features, and similar materials (“Site Content”), together with BookMyCelebrity trademarks, service marks, trade names, logos, and other proprietary materials, except third-party or Artist Content, are owned by or licensed to BookMyCelebrity and are protected by applicable intellectual property laws.

Except where expressly permitted by these Terms of Use or applicable law, BookMyCelebrity does not grant you any express or implied rights in the Website, Services, or Site Content.

You may access Artist Content for your personal, informational, and non-commercial use through the functionality intentionally provided by the BookMyCelebrity Services.

Artist Content and Site Content are provided on an “AS IS” and “AS AVAILABLE” basis for their intended purpose.

Except where expressly permitted by BookMyCelebrity or the relevant rights holder, you may not download, copy, reproduce, distribute, transmit, broadcast, publicly display, sell, license, modify, commercially exploit, or otherwise use Artist Content or Site Content outside the functionality provided by the Services.

Intellectual Property Rights

Subject to the rights of third parties and Artist Content contributors, the content, technology, design, branding, software, interfaces, and other materials forming part of the BookMyCelebrity Services are owned by or licensed to BookMyCelebrity and are protected under applicable intellectual property laws.

For purposes of these Terms, “Intellectual Property Rights” includes copyrights, trademarks, service marks, trade names, trade dress, logos, patents, designs, domain names, database rights, software rights, moral rights, broadcasting rights, distribution rights, reproduction rights, adaptation rights, communication rights, performance rights, display rights, and other intellectual property rights recognized under applicable law.

Intellectual Property Rights arising in connection with the BookMyCelebrity domain name, Website, platform, software, technology, branding, and digital services shall remain with BookMyCelebrity or the relevant rights holder.

No provision of these Terms transfers ownership of BookMyCelebrity intellectual property to a user or member.

Prohibited and Objectionable Content

BookMyCelebrity does not permit the use of its Services for unlawful, sexually exploitative, obscene, abusive, violent, harassing, or otherwise prohibited content or activities.

Users must not publish, upload, transmit, or make available content that contains unlawful sexual material, exploitation, nudity where prohibited by applicable law, obscene or sexually explicit material, excessive violence, harassment, threats, or other material prohibited by applicable law.

Users are responsible for ensuring that their profiles, photographs, videos, messages, portfolios, and other Content comply with applicable laws and these Terms of Use.

BookMyCelebrity reserves the right to remove or restrict prohibited Content and may suspend or terminate accounts involved in serious or repeated violations.

Where required or permitted by law, BookMyCelebrity may cooperate with law enforcement authorities or comply with valid legal orders or requests.

If you become aware of misuse of the BookMyCelebrity Services, you may report the matter to us at contact@bookmycelebrity.co.in.

Copyright Infringement Policy

BookMyCelebrity respects intellectual property rights and may take appropriate action against accounts or users who repeatedly infringe the intellectual property rights of BookMyCelebrity, artists, celebrities, clients, or third parties.

If you believe that your copyrighted work has been copied or used through the BookMyCelebrity Services in a manner that constitutes infringement, you may notify us with sufficient information to identify the copyrighted work, the allegedly infringing material, its location on the Website, your contact information, and evidence of your rights or authorization to act on behalf of the rights holder.

BookMyCelebrity may review the complaint and take appropriate action in accordance with applicable law.

Member Accounts

To access certain BookMyCelebrity Services, you may be required to create an account and register as an Artist, Client, or another permitted type of user (collectively, “Members”).

Members may receive or create login credentials and are responsible for maintaining the confidentiality and security of their usernames, passwords, and other account credentials.

Your right to use the BookMyCelebrity Services is personal to you, and you are responsible for activities conducted through your account, whether authorized by you or not, subject to applicable law.

You agree to notify BookMyCelebrity promptly if you become aware of unauthorized use of your account or any other security breach.

You acknowledge that interactions between Members are primarily between the relevant parties and that BookMyCelebrity is not obligated to monitor or resolve every dispute between Members.

As an Artist or Client, you expressly agree:

• To provide BookMyCelebrity with accurate, complete, and current registration information.
• That BookMyCelebrity may suspend or terminate your account and restrict current or future use of the Services if we reasonably determine that information provided by you is materially false, inaccurate, outdated, incomplete, or misleading.
• Not to intentionally bypass, circumvent, or avoid BookMyCelebrity's involvement in an event or engagement where the applicable booking, commercial, or program terms require BookMyCelebrity to remain involved.
• To protect your username and password at all times.
• To notify BookMyCelebrity immediately of unauthorized use of your account or where your username or password needs to be deactivated due to security concerns.
• That BookMyCelebrity is not responsible for unauthorized access to or alteration of your account information resulting from circumstances outside our reasonable control.
• That physical materials submitted to BookMyCelebrity may be retained, returned, destroyed, or otherwise handled according to the applicable submission or engagement terms.

Your username and password are personal to you and should not be shared with unauthorized persons.

BookMyCelebrity will not be responsible for harm arising from theft, unauthorized disclosure, or misuse of account credentials to the extent such harm results from your failure to protect your credentials or from circumstances outside our reasonable control.

In certain circumstances, BookMyCelebrity may need to access an account for legitimate support, maintenance, security, fraud-prevention, technical, or administrative purposes. By using the Services, you acknowledge that such limited access may occur where reasonably necessary.

Because the Internet operates across different jurisdictions, you agree to comply with applicable laws concerning online conduct, acceptable Content, privacy, data transmission, and the use of the Services.

Member Conduct

You may not use the BookMyCelebrity Services for any purpose that is unlawful, fraudulent, prohibited by these Terms of Use, or contrary to any applicable additional terms or policies.

BookMyCelebrity may suspend or terminate access where a user violates these Terms or engages in conduct that reasonably creates legal, security, operational, or safety concerns.

You expressly agree not to:

• Act as an unauthorized agent, affiliate, representative, reseller, or intermediary of BookMyCelebrity or use the Services or Content for a commercial purpose outside the intended functionality without written permission.
• Access, monitor, copy, extract, or collect Website Content or information through robots, spiders, crawlers, scrapers, automated systems, or manual processes where such activity is not expressly authorized.
• Take any action that imposes or may reasonably impose an excessive, unreasonable, or disproportionate load on BookMyCelebrity infrastructure.
• Frame, mirror, reproduce, embed, or incorporate substantial portions of the BookMyCelebrity Services into another website or service without prior written permission.
• Use the BookMyCelebrity Services for unauthorized commercial purposes.
• Sell or sublicense access to the BookMyCelebrity Services through another website or service without authorization.
• Use the Services primarily to generate advertising, subscription, resale, or other commercial revenue without authorization.
• Sell advertising using BookMyCelebrity Site Content or Artist Content without authorization.
• Use the Services or Content in a manner that BookMyCelebrity reasonably determines competes with, displaces, copies, or materially interferes with the BookMyCelebrity platform or business.

Unauthorized commercial use does not include an artist or entertainment professional using the BookMyCelebrity Services to promote their own legitimate artistic or entertainment activities in accordance with the intended functionality of the platform.

The following activities are also strictly prohibited:

• Use of strongly vulgar, obscene, abusive, or otherwise harmful language.
• Racially, ethnically, religiously, or otherwise discriminatory or objectionable content.
• Harassing, intimidating, stalking, threatening, or abusing other users.
• Libellous, defamatory, fraudulent, or otherwise unlawful statements.
• Online vandalism or deliberate disruption of the Services.
• Impersonating another person, artist, celebrity, agency, company, or organization.
• Posting, distributing, transmitting, or promoting unlawful Content.
• Invasion or unauthorized disclosure of another person's privacy.
• Actions or Content that may harm, exploit, or endanger minors.
• Making available materials that infringe the rights of another person or entity.
• Sending unsolicited bulk messages, junk mail, or spam.
• Uploading, emailing, transmitting, or distributing malicious computer code.
• Attempting to hack, reverse engineer, disrupt, or gain unauthorized access to the Website, Services, or associated systems.

BookMyCelebrity may cooperate with law enforcement authorities or comply with valid court orders or lawful requests requiring disclosure of information relating to unlawful activity.

We reserve the right, but not the obligation, to enforce these Terms through moderation, investigation, account restrictions, legal action, or other lawful measures.

Fees and Terms

When an Artist or Client registers or uses BookMyCelebrity Services, applicable charges, commissions, service fees, or other commercial terms may apply depending on the relevant program, service, booking type, or engagement arrangement.

BookMyCelebrity may promote artists through profiles and related platform features and may facilitate enquiries or opportunities from Clients. However, the creation of a profile or participation in the platform does not guarantee that an Artist will receive any assignment, booking, performance opportunity, or minimum amount of work.

If a Client expresses interest in an Artist for a particular performance or engagement, BookMyCelebrity may contact the relevant Artist or authorized representative regarding the opportunity.

Depending on the applicable program, BookMyCelebrity may charge a commission or service fee ranging from 2% to 20% of the applicable transaction, remuneration, booking value, or other agreed basis.

The exact applicable percentage, calculation method, payment responsibility, and applicable charges may vary by program and will be communicated in the relevant commercial, booking, engagement, or service terms.

Unless expressly guaranteed in writing, BookMyCelebrity does not guarantee that an Artist will receive assignments, bookings, or any specific level of earnings through the platform.

Where the applicable program requires BookMyCelebrity to facilitate or remain involved in a booking, Clients and Artists must not intentionally bypass the platform, circumvent applicable fees, or enter into an undisclosed direct arrangement in violation of the relevant commercial terms.

Any consequences for violating such terms will be determined by the applicable agreement, booking terms, or commercial arrangement.

Termination of Service

BookMyCelebrity may, at its discretion and subject to applicable law, suspend, restrict, deactivate, or terminate your account or access to all or part of the BookMyCelebrity Services, including removal of Artist Content, where we reasonably believe that you have violated these Terms of Use or applicable law, engaged in fraudulent or harmful conduct, created a security risk, or otherwise acted inconsistently with the purpose or requirements of the Services.

Where legally permissible and appropriate, BookMyCelebrity may take such action without prior notice.

To the maximum extent permitted by applicable law, BookMyCelebrity will not be liable to you or a third party solely because your access to the Services has been suspended or terminated in accordance with these Terms.

You agree not to attempt to circumvent a suspension or termination by creating unauthorized accounts or using another person's account.

If you are dissatisfied with the BookMyCelebrity Services, disagree with any portion of these Terms of Use, or have a dispute regarding the Services, you may discontinue using the Services, subject to any rights and remedies available under applicable law.

The BookMyCelebrity Services may contain links to external websites, applications, resources, social media platforms, or third-party services.

Because BookMyCelebrity does not control such external websites or resources, you acknowledge that we are not responsible for their availability, content, advertising, products, services, privacy practices, security, or other materials.

BookMyCelebrity does not necessarily endorse third-party websites or resources linked from the Website.

To the maximum extent permitted by applicable law, BookMyCelebrity will not be responsible for direct or indirect losses or damages arising from your access to, use of, or reliance upon third-party websites, resources, products, or services.

Children / Minor Policy

The BookMyCelebrity Website and Services are primarily intended for individuals who are legally capable of entering into applicable agreements.

Where a person below the age of 18 seeks to use the Services, such use should occur only with the involvement, consent, and supervision of a parent, legal guardian, or other person legally authorized to provide such consent where required by applicable law.

Parents and legal guardians are responsible for supervising the activities of minors under their care and for ensuring that their use of the Services complies with applicable law and these Terms of Use.

BookMyCelebrity does not knowingly permit minors to enter into contractual or financial arrangements where such arrangements are prohibited by law.

Indemnity

You agree, to the extent permitted by applicable law, to defend, indemnify, and hold harmless BookMyCelebrity, its owners, directors, officers, employees, representatives, agents, vendors, contractors, affiliates, service providers, and other authorized partners from claims, demands, liabilities, losses, damages, costs, and reasonable legal expenses arising from or relating to:

• Content, materials, information, or communications submitted, posted, transmitted, or otherwise made available by you through the BookMyCelebrity Services;
• Your violation of these Terms of Use;
• Your violation of applicable law;
• Your violation of any third-party rights;
• Your infringement of copyright, trademark, privacy, publicity, or other proprietary rights; or
• Your fraudulent, unauthorized, or unlawful use of the Services.

This obligation applies to claims arising from your conduct or Content to the extent permitted under applicable law.

Trademark Information

BookMyCelebrity, its name, logo, branding, service names, design elements, and other associated marks may constitute trademarks or proprietary identifiers of BookMyCelebrity or its licensors.

BookMyCelebrity does not guarantee uninterrupted access to the Services or that all information, profiles, communications, Content, or personal settings will always be stored, maintained, available, accurate, complete, or error-free.

No advice, information, recommendation, representation, or communication obtained through the BookMyCelebrity Services, whether oral or written, shall create any warranty or guarantee not expressly stated in these Terms of Use.

To the maximum extent permitted by applicable law, BookMyCelebrity, its owners, affiliates, directors, officers, employees, agents, vendors, and service providers shall not be liable for indirect, consequential, exemplary, incidental, special, or punitive damages, including loss of profits, loss of business, loss of reputation, loss of information, or similar losses arising from or relating to your use of the BookMyCelebrity Services.

Some jurisdictions may not permit the exclusion or limitation of certain types of damages or warranties. Accordingly, certain limitations may not apply to you to the extent they are prohibited by applicable law.

BookMyCelebrity disclaims liability, to the maximum extent permitted by law, for losses arising from communications or dealings between users, artists, celebrities, agencies, advertisers, businesses, or other third parties using the Services, except where BookMyCelebrity has expressly assumed responsibility for the relevant matter.

Your communications and dealings with third parties are subject to the applicable terms agreed between you and the relevant third party.

If you promote a contest, competition, sweepstakes, giveaway, promotional campaign, or similar activity through or using BookMyCelebrity without our prior written approval, you do so at your own responsibility and assume any resulting legal or financial obligations.

You agree to hold BookMyCelebrity harmless from claims arising from an unauthorized contest, giveaway, sweepstakes, or promotional activity conducted by you.

BookMyCelebrity shall not be responsible for your interactions with organizations, Artists, Clients, agencies, celebrities, or individuals found through the BookMyCelebrity Services, including the performance of services, payment arrangements, availability, cancellations, warranties, representations, or other terms associated with such dealings, except where BookMyCelebrity has expressly agreed otherwise.

Such dealings are primarily between the relevant parties and remain subject to their applicable agreement and the mandatory rights provided by law.

General Provisions

If there is any claim or dispute concerning the BookMyCelebrity Services or these Terms of Use, the matter shall be governed by the laws of India, without regard to conflict-of-law principles, subject to applicable mandatory legal protections.

Subject to applicable law, you agree to submit to the jurisdiction of the courts having appropriate jurisdiction in Lucknow, Uttar Pradesh, India with respect to matters arising from or relating to these Terms of Use or the BookMyCelebrity Services.

The BookMyCelebrity Services are offered from India. We do not represent that all materials or Services available through the Website are appropriate or available for use in every jurisdiction.

Users who access the Services from other jurisdictions do so on their own initiative and are responsible for complying with applicable local laws.

You affirm that you are at least 18 years of age, or otherwise have the legal capacity and authorization required to enter into these Terms of Use. Where applicable law permits a minor to access limited Services with parental or guardian consent, such access remains subject to the applicable legal requirements and these Terms.

These Terms of Use, together with documents expressly incorporated into them, including applicable Artist, Client, booking, engagement, payment, cancellation, or program terms, constitute the complete agreement between you and BookMyCelebrity concerning your use of the Services and supersede previous understandings or communications relating to the same subject matter.

These Terms are subject to applicable laws and lawful legal processes. Nothing contained in these Terms limits BookMyCelebrity's right or obligation to comply with statutory requests, governmental requirements, court orders, or lawful requests concerning your use of the Services or information processed in connection with such use.

These Terms and other communications exchanged electronically may be admissible in judicial, arbitration, administrative, or other proceedings to the extent permitted by applicable law, in the same manner as other business records.

YouTube Terms of Service

BookMyCelebrity may use YouTube services or YouTube API Services to enhance the user experience and provide certain content integrations or features.

Where YouTube API Services are used, your use of relevant YouTube-related functionality may also be subject to the YouTube Terms of Service.

Users are encouraged to review the applicable YouTube terms before using features that rely upon YouTube services.
